General Terms and Conditions
1. The design, organisation and delivery of the activities are the responsibility of Mirando al Sur, S.L. and its PirineoSur brand. Payment of the booking deposit implies acceptance of these General Terms and Conditions.
2. Prices
2.1 The prices for each activity are those displayed on www.mirandoalsur.es and www.pirineosur.es.
2.2 Prices include VAT under the special scheme for travel agencies and everything listed in the “Included” section of each activity page.
2.3 Scheduled activities require the minimum number of participants stated on each activity page. If that minimum is not reached, the price shown for the actual number of participants will apply. The participant may choose to attend and pay the price corresponding to that group size, or receive a voucher for the amount paid, which can be used for another activity.
2.4 Prices do not include any expenses necessary to meet visa requirements or other entry requirements for particular countries, such as medical insurance or special accident insurance.
3. Booking, payment and cancellation of scheduled activities and ski lessons
3.1 Places are reserved strictly in the order in which the booking deposit specified for each activity is paid.
3.2 For telephone bookings, availability will be confirmed at the time of the call. You then have a maximum of 48 hours to pay the deposit specified on the information page into the indicated BANCO SABADELL account, quoting the activity and your name.
3.3 For online bookings through the shop, your place is available immediately and you must follow the instructions sent to your contact email address.
3.4 Where an individual arrangement has been made not to pay for an activity in full at the time of booking, the balance must be paid before the deadline set for that booking. In all cases, the activity must be paid in full one month before it starts. Otherwise, Mirando al Sur, S.L. may cancel unpaid places, and the customer will forfeit the amounts already paid.
3.5 Cancellation or modification of a booking by the customer is subject to the following penalties. In all cases, cancellation entails forfeiture of the deposit:
- More than two months before the programme starts: a refund of 100% of the amount paid, excluding the booking deposit, which is non-refundable.
- Between two months and one month before the start: 50% refund.
- Less than one month before the start: no refund.
3.6 If there is a waiting list when the activity’s payment deadline is reached, reserved places that have not been paid in full will be offered to people on that waiting list.
3.7 Minors must provide parental consent on the day of the activity, together with a photocopy of the parent’s or guardian’s identity document.
3.8 If a customer’s cancellation or modification increases the price payable by the other participants, that increase will be deducted from any refund due under section 3.5.
3.9 The student/customer is responsible for all equipment provided. If any equipment is lost, left behind or otherwise not returned, the customer must pay its replacement value as a new item. This also applies to any shared equipment lost by the customer during the activity or course, including ropes, cams, nuts and carabiners.
3.10 The specific cancellation policy for ski lessons is:
- Cancellation more than 7 days before the lessons start: 100% refund, less €10 in administration fees.
- Cancellation between 5 and 7 days before the lessons start: 75% refund.
- Cancellation between 3 and 4 days before the lessons start: 50% refund.
- Cancellation less than 3 days before the lessons start: no refund.
4. Booking and payment for bespoke activities and other conditions for international activities outside Spain
All international activities, any activities identified as bespoke, and all activities that do not appear on the website are considered bespoke activities.
4.1 The booking deposit, whose amount is agreed individually for each activity, must be paid into the indicated BANCO SABADELL account, quoting the name of the person or company booking the activity. No part of the booking deposit will be refunded if the customer cancels. Where an activity is not paid in full at the time of booking, the balance must be paid before the deadline set for that booking. In all cases, the activity must be paid in full one month before it starts. Otherwise, Mirando al Sur, S.L. may cancel unpaid places, and the customer will forfeit the amounts already paid. If the customer changes the agreed conditions of a bespoke activity, such as the number of people, the activity, routes or dates, this may result in the loss of advance payments and cancellation of the trip or activity, at the discretion of Mirando al Sur, S.L.
4.2 Participants must then provide their first name, surname, identity document number and any other required details, such as clothing and shoe sizes, through the online customer form.
4.3 If the customer cancels, section 4.1 applies. The penalty set out in section 3.5 also applies to the remaining amount paid for the activity.
4.4 Minors must provide parental consent on the day of the activity, together with a photocopy of the parent’s or guardian’s identity document.
4.5 Mirando al Sur S.L. has an agreement with the Club de Esquí y Montaña PirineoSur for mountain guiding on certain international activities. Mirando al Sur, S.L. organises the trip, while the Club de Esquí y Montaña PirineoSur provides the guiding. Guides on the international activities offered by Mirando al Sur S.L. may act as volunteer or professional guides of the Club de Esquí y Montaña PirineoSur during the mountain activities. For activities that require it, the person making the booking agrees to be registered as a member of the Club de Esquí y Montaña PirineoSur for the year in which the booked activity takes place. The membership fee is included in the price of the trip or activity.
4.6 Participants wishing to pay for an activity with vouchers or gift cards must state this when booking.
4.7 Any modification made less than 7 days in advance entails forfeiture of the entire voucher.
4.8 If an activity cannot take place for reasons beyond the company’s control, such as weather, lack of snow or an impassable route, no refund of the amount paid is due. An alternative date will be sought for the activity or course, or a similar alternative activity will be provided. Specifically, snowshoeing, via ferrata or climbing will be replaced by hiking, unless the customer and Mirando al Sur, S.L. expressly agree otherwise.
4.9 The student/customer is responsible for all equipment provided. If any equipment is lost, left behind or otherwise not returned, the customer must pay its replacement value as a new item, using the price shown on www.barrabes.com as a reference, or on other reference websites if the item cannot be found there. This also applies to any shared equipment lost by the customer during the activity or course, including ropes, cams, nuts and carabiners.
6. Insurance and official complaint forms
6.1 All participants are covered by the accident insurance taken out by Mirando al Sur, S.L. The company also holds public liability insurance and has official complaint forms available.
7. Changes to routes and activities
7.1 Mountain activities may be changed because of weather conditions, the conditions of the routes or participants’ physical, technical and psychological capabilities. Itineraries may be modified or partially or completely suspended if circumstances make this advisable, at the discretion of the guide and/or the company. At the time of booking, the company may agree individually with each customer on a refund of the amount paid in the event of an activity being suspended.
7.2 To ensure the activity runs properly, the responsible guide may adapt it according to the forecast from AEMET, the Spanish State Meteorological Agency, or other international, national or local weather services.
7.3 However, if an activity has already begun and must be suspended for the reasons set out in section 7.1, no refund will be made, given the unpredictable nature of those external factors. For this purpose, an activity begins when the responsible guide arrives at the activity’s meeting point.
7.4 If the guide assigned to an activity or course cannot deliver it because of physical incapacity or force majeure, and Mirando al Sur, S.L. cannot find a replacement, or if the weather, snow or other conditions needed for a course or activity are unsuitable, it will be postponed to a later date. For activities lasting several days, once they have begun, no refund will be made if the guide cannot continue the activity or course because of injury, illness or force majeure, or if the weather, snow or other necessary conditions change so that it is no longer possible to continue.
8. The guide’s responsibilities
8.1 All activities offered by Mirando al Sur, S.L. and its PirineoSur brand are led by qualified mountain guides.
8.2 The guide has overall responsibility for the activity and makes the decisions most appropriate to its proper running, taking into account the weather, route conditions and participants’ physical fitness, psychological condition and technical training.
8.3 Participants undertake to follow the guide’s instructions. If they do not, both Mirando al Sur, S.L. and the guide disclaim all responsibility for any resulting consequences. Where appropriate, this may lead to the participant being excluded or even to the activity being suspended, with forfeiture of all rights.
9. Right of admission
9.1 Mirando al Sur, S.L. and, where applicable, the activity guide reserve the right to refuse admission to anyone who, immediately before the activity starts, does not have the physical, psychological or technical capabilities required, or lacks the specified equipment.
9.2 Likewise, anyone who arrives without the equipment specified in the “Required equipment” section or by email may not take part, at the guide’s discretion.
9.3 The situations described in section 9.1 and section 9.2 entail forfeiture of all the participant’s rights and of the amount paid for the activity.
9.4 Waiting time: the guide or guides will wait until 15 minutes after the agreed start time. If the customers have not arrived by then, the guide or guides may cancel the activity.
9.5 If the customer substantially changes or attempts to change the conditions of a trip or activity, such as reducing the final number of places below the number booked or changing routes or dates, Mirando al Sur, S.L. may cancel the trip unilaterally, and the customer will forfeit the deposit or advance payments.
10. Image rights and data protection
10.1 Participants in all activities may give or withhold consent for images taken during the activities to be used by Mirando al Sur, S.L. and its PirineoSur brand in advertising campaigns, on social media or in other future initiatives.
10.2 When booking, customers provide their data to Mirando al Sur. In accordance with Organic Law 15/1999 of 13 December on the Protection of Personal Data, those data will be included in the file registered with the Spanish Data Protection Agency. Customers may exercise their rights of access, rectification, cancellation and objection by sending an email to Mirando al Sur.
